Consideration of and action on entering into agreements with Lockwood, Andrews & Newman (LAN), Tank Industry Consultant and amending the agreement with Terracon for the engineering, design and project management associated with the Avon Elevated Water Storage Tank Rehabilitation.

Summary: 

In June 2023, the piping below the Avon elevated Storage Tank broke, damaging the floor, washing material out, and rendering the tower not usable until an evaluation could be performed along with repairs.

Tank Industry Consultants was hired to evaluate the damages to the tank, as well as the overall condition of the tank itself.  In July 2023 the evaluation was completed and results were sent to us in August.  Their recommendations, which can be found starting on page 18 of the attached report, includes repairs to the foundation, site renovations, tank and site security improvements, as well as recommending repainting/rehabilitating the exterior surfaces of the tank, and repainting of the interior tank.

The estimated cost for the repairs to the damage, as well as rehabilitation of the tank (which can be found on page 27 of the attached report, are estimated to be $678,000.

At this current time, we have 3 existing contracts associated with the damages that occurred to the Avon Tank. 

                     July 24, 2023: The agreement with Tank Industry Consultants, mentioned above, which had a not to exceed cost of $50,000.

                     August 15, 2023: An Agreement with Lockwood, Andrews & Newman, Inc. (LAN) in the amount of $9,000 for the initial analysis coordination and design development phase services.

                     August 22, 2023: An agreement with Terracon, in the amount of $49,200, in which they performed a field exploration services, including excavating the soils in the center or the tank and dynamic cone penetrometer test.

Now that the initial review and assessment of the tank have been completed, we are requesting to enter into new agreements (or amended agreement in one case) for the actual design, consultation, project management, etc., for the actual rehabilitation of the tank.

1.                     At this time, we are seeking Council approval to enter into an agreement with Lockwood, Andrews & Newman, Inc. (LAN) to provide engineering and design services (construction drawing and specification), as well as project management and other services for the proposed Avon St. Elevated Storage Tank Rehabilitation.

LAN will bill for its services on the basis listed in the following sentences using the Schedule of Rates and Terms entitled Estimated Level of Effort (“Schedule of Rates”) attached as Schedule B of the Agreement.  LAN has provided an estimate of the fees for the design phase services is a lump sum fee of $45,000.00 and the fee for bidding phase services is on a time and materials, not to exceed, with a maximum of $10,000.00. LAN proposes to provide our construction phase services on a time and materials basis accrued in accordance with the attached estimated fee, based on an estimated 90 calendar days of construction.  They estimate the fee for their construction phase services to be approximately $60,000. Their estimated fee does not include overtime or costs associated for additional site visits if required because materials used were found not to be in compliance with the project plans or specifications.  Any additional services requested and not part of the estimated fee will be charged in accordance with the attached Schedule of Fees found in Schedule B. 

2.                     Supplement to the existing agreement with Terracon, for an additional $6,000.  Terracon will work with LAN to provide additional geotechnical engineering services to support the backfill and pipe support within the elevated storage tank.

3.                     Enter into an agreement with Tank Industry Consultants in the amount of $7,000 for engineering services, project management and other services associated with this project.

Fiscal/Budgetary Impact: 

The total cost of all three agreements is $128,000.  We currently have $55,000 available in 400-500-4240 for consultant fees, as well as $85,800 available in the Surface Water Treatment Plant’s contingency fund.  This will be sufficient to cover the cost of all three agreements. 

Once the engineering and design work has been completed, the rehabilitation project will go out for official bids. Therefore, the contract for repairs will be awarded at a later date.

 

Recommended action

Approve the agreements with LAN, Terracon and Tank Industry Consultants for the engineering, design and project management associated with the Avon Elevated Water Storage Tank Rehabilitation.
