Summary: 

The Planning and Zoning Commission held a public hearing on August 3, 2026 and took action in their regular meeting on the same night.   It is their recommendation to grant the request of 2801 P Street LLC for a Specific Use Permit for a truck yard and laydown yard to be constructed at 2851 E. P. Street.  The SUP now comes to city council for their action.

From the City Ordinances: 

The City Council shall consider the application and the accompanying site plan. The City Council may approve or deny an application for a specific use permit. In granting a permit, the City Council may impose such requirements and conditions, in addition to those expressly stipulated in this ordinance for the particular use, as it may deem necessary for the protection of adjacent properties and the public interest.

17.04.6.  City Council Consideration. In granting or denying an application for a specific use permit, the City Council shall consider the following factors, among others:

                     Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site.

                     Safety from fire hazard, and measures for fire control.

                     Protection of adjacent property from flood or water damage.

                     Noise producing elements; and glare of vehicular and stationary lights and effects of such lights on established character of the neighborhood.

                     Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties.

                     Street size and adequacy of pavement width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood.

                     Adequacy of parking, as determined by requirements of this ordinance for off-street parking facilities in the use district in which the site is located; location of ingress and egress points for parking and off-street loading spaces; and protection of public health by surfacing on all parking areas to control dust.

                     Such other measures as will secure and protect public health, safety, morals, and general welfare.

                     The compliance with the overall zoning use plan of the city of the proposed use.

From requestor:

2801 P Street LLC is requesting a Specific Use Permit (SUP) for the proposed improvement at 2851 E. P Street Deer Park TX as required by article 8.02.1. The proposed improvement will be for use as a truck yard and laydown yard (use group 34) as allowed under the current zoning (Industrial Park (M1) of the property. This use group and zoning requires a SUP for these allowed activities which will enable the owner to operate his business. The property is bordered only by the same industrial park zoning being used in ways similar to that proposed under this permit application. The West boundary is a drainage improvement (Tributary 1.78 To Willow Springs Bayou).

Improvements and operation of the property will follow article 12.01 .34 requirements for any principal and permitted uses in the use group including dust control, fencing, and placement of equipment and materials. There will be no hazardous or combustible materials and no use of shipping containers in the proposed improvements. All other codes and ordinances related to the construction permitting and operation of the improvements will be followed. Included on the site will be drainage improvements to manage stormwater runoff and a small office building.

This SUP is critical to allow the business of the property owner to operate under the principal uses permitted for Group 34 in zoning M1.

Provide council direction on the ordinance to accept or deny the recommendation of Planning & Zoning on the specific use permit for 2801 P Street LLC to create a truck yard and a laydown yard to be constructed at 2851 E. P. Street.
