Title

Consideration of and action on an ordinance reauthorizing Building Permit Fees.

Body

Summary:

A Public Hearing, in pursuant to the provisions of Texas House Bill 1922, as outlined below, was held this evening.  This agenda item is to officially adopt the ordinance for reauthorization of our current building permit fees.

Pursuant to the provisions of Texas House Bill 1922, which went into effect on January 1, 2024, a city’s governing body must hold a public hearing and vote to reauthorize any city fee charged as a condition of constructing, renovation, or remodeling a residential or commercial structure at least once every ten years.  Under the bill, if a city fails to do so by the tenth anniversary of the fee being adopted or reauthorized, the fee will be automatically abolished by law.

In June of 2019, Ordinance 4081 was adopted by City Council authorizing our current building permit fee schedule. Although the current ordinance is only a few years old, staff recommended that we hold a public hearing and vote to reauthorize the existing fees due to the fact that HB 1922 has just went into effect. This public hearing was held earlier tonight.  From here on out, we will reauthorize these fees at a minimum of every 10-years.

Attached you will find the proposed ordinance reauthorizing the building permit fees and information on HB 1922.
