Consideration of and action on rescinding the award of the G105-04-01 Channel Improvement Project to Panther Construction, LLC.

Summary:
At the May 19, 2026 meeting City Council awarded the G105-04-01 Channel Improvement Project to Panther Construction, LLC in the amount of $618,644.91. We had received six (6) bids at the bid opening for this project. Cobb Fendley, who is the engineer of record for this project, reviewed all bids and researched qualifications and recommendation for the 3 lowest bidders. Panther Construction met all the requirements and received positive recommendation, therefore Cobb Fendley recommended them for award.
An award letter, along with all contract documents, were sent to Panther Construction on May 22nd for their execution. They were dragging their feet when it came to returning the signed contract documents. On June 4th, we held a virtual meeting between city staff, Cobb Fendley and Panther Construction to discuss their concerns. Panther said they were hesitant to sign the contract because they felt access to the job site limited their ability to properly perform the work in a timely manner. They asked about pulling out of the project. The following day, at noon on June 5th, they sent an email stating they were declining this project due to access point issues.
The plan at this time is to award the project to the next qualified bidder, which will a separate/future agenda item.
