Title
Public hearing on reauthorizing Building Permit Fees.
Body
Summary:
At the January 16, 2024 Council meeting, City Council approved holding a public hearing to reauthorize our current building permit fees.
Pursuant to the provisions of Texas House Bill 1922, which went into effect on January 1, 2024, a city’s governing body must hold a public hearing and vote to reauthorize any city fee charged as a condition of constructing, renovation, or remodeling a residential or commercial structure at least once every ten years. Under the bill, if a city fails to do so by the tenth anniversary of the fee being adopted or reauthorized, the fee will be automatically abolished by law.
In June of 2019, Ordinance 4081 was adopted by City Council authorizing our current building permit fee schedule. Although the current ordinance is only a few years old, staff is recommended that we hold a public hearing and vote to reauthorize the existing fees due to the fact that HB 1922 has just went into effect. From here on out, we will reauthorize these fees at a minimum of every 10-years.
Attached you will find the proposed ordinance, information on HB 1922 and the ordinance that called the public hearing. The agenda item to adopt the ordinance is on tonight’s agenda.
