Authorization to award bid to Ecological Restoration Services LLC (ERS) for the Deer Park WetlandsTallow Mitigation Project.

 

Body Summary: 

Advertising was done on February 20, 2019 and February 27, 2019 to seek bids.

There was a mandatory pre-bid meeting on March 6, 2019.

Bids were opened at 1:30 PM on Thursday, March 14, 2019.

All three vendors attended the pre-bid meeting, at that time vendors were asked to submit questions which would be uploaded to Civcast for review. The responses are attached that were uploaded to Civcast before bids were submitted.

One of the questions asked: Can the City provide guidance for the proper post treatment methodology (remove from site or leave standing) Chinese tallow with a dbh between 2-3”?

The response from City staff to the question that was documented on the Civcast site was to remove from the Wetlands site.

Bids were received March 14, 2019 with the following bid amounts:

Earth Balance                                                                                    $73,485.00

ERS                                                                                                         $215,393.22

Millis Development & Construction                     $391,000.00

Due to the extensive difference between the lowest apparent bidder and the next lowest bidder, the City sent questions to clarify Earth Balance’s bid. The City asked “does the cost include removal of all Chinese Stems under 3” dbh?”

Earth Balance’s response on Friday, March 22nd was “if the intention of the City is to remove all stems up to 3” dbh, we cannot do that for our submitted price.” Because the lowest apparent bidder, Earth Balance, cannot do the submitted price we are recommending authorization to award the bid to ERS. ERS recognized the Civcast questions and answers and acknowledged their understanding of the removal of all Chinese stems under 3” dbh.

The ERS bid of $215,393.22 is a more accurate fee relative to the third bid which was $391,000.00.

 

Fiscal/Budgetary Impact: 

This project is being funded by a 100% grant match from the Texas Parks & Wildlife Department (TPWD) under the name Texas Parks & Wildlife Local Park Grant up to a maximum of $400,000. The City’s portion of the project will be $500,000, with the additional $100,000 being funded out of Bond Fund 34. Because this is a reimbursement grant, the City’s grant funded expenditures will be recorded in the Special Revenue Grant Fund (Fund 105) as a receivable until such time as reimbursement is received from the TPWD.
