Rescind the awarding of bid and rejecting the bids received for the construction of the Hike and Bike Trail from X Street to P Street and authorization to rebid project.

Summary: 

City Council authorized seeking bids for the construction of the Hike and Bike Trail at the February 2, 2021 regular City Council Meeting. The City of Deer Park in partnership with Burditt and Associates developed specifications and construction documents for work in this section of the comprehensive Hike and Bike Trail project.

Funds were approved for this project by the voters at the 2015 Type B election as more specifically described in the proposition ballot language and for the amount of $500,000.

On March 18, 2021, the City received nine (9) bids for construction of the Hike and Bike trail from X street to P street.  After review of the bids by Burditt and Associates and City staff, it was determined that General Petro Chem Industrial was the apparent lowest responsible bid. The recommendation was to award the base bid of $283,962.41 and add alternate of $44,160.00 for a total of $328,122.41 to General Petro Chem Industrial for this project.

At the April 20, 2021 regular City Council meeting. City Council approved the award of the bid to General Petro Chem Industrial to complete the project.

In the days after awarding of the bid, it was brought to the attention of City of Deer Park staff and Burditt and Associates that inaccuracies had occurred in the bidding process. Discussions were held with the City Attorney and City staff to determine the best course of action. The Notice to Bidders for this project states, “The City reserves the right to reject any and all bids, or parts of bids to waive any and all technicalities, and to accept any bid, or part of bid, which it deems advantageous to itself. Therefore, after further review of the bid process, the City of Deer Park has decided that in the best interest of the City that the award of bid be set aside and all bids received be rejected. While General Petro Chem’s bid was not the cause of these inaccuracies; it along will all other bids for the project will be rejected.

City staff would request that City Council reauthorize the approval to seek bids for the Hike and Bike project.
